Smt. Darshan Kaur, her husband and son, namely Ajit Singh and Manjinder Singh, have filed this petition under Section 482 of the Code of Criminal Procedure for issuing direction to respondents No.1 and 2 to provide protection, as they are having apprehension to their life and liberty at the hands of respondents No.3 to 7.
I have heard counsel for the petitioners and gone through the contents of the petition.
In this case, petitioner No.3 executed a registered sale deed in the year 2002. Subsequently, in the year 2004, a civil suit was filed by petitioner No.3 challenging the said sale deed. That suit is still pending before the civil court. Now, it is case of the petitioners that respondent No.4 in connivance with the police is pressurising petitioner No.3 to withdraw the said suit and they are harassing the petitioners. It has been stated in the petition that a criminal case has been registered against the petitioners on 3.8.2006 under Sections 467, 468, 471, 420 and 120-B IPC, in which challan has already been filed, and in connection with that case, it has been alleged that respondent No.3 is raiding house of the petitioners.
Keeping in view the aforesaid facts and circumstances of the case, I am of the opinion that apprehension of the petitioners is totally mis- placed and motivated.
