Heard. This Civil Revision, filed under Article 227 of the Constitution of India, is directed against the order dated December 23,2006, whereby the petitioner was allowed to withdraw a sum of Rs.30,000/- instead of giving him permission to withdraw the entire amount of Rs. 97,368/-.
Contention of learned counsel for the petitioner is that a sum of Rs.60,000/- taken by way of loan from his relation is yet to be paid by the petitioner,but this assertion does not appear to be genuine on the face of it inasmuch as the petitioner/claimant is stated to have been treated in a Govt. Hospital for about 15 days. There is nothing on the file which could show that the petitioner had spent any substantial amount on his treatment or that now he is unable to earn anything. Be that as it may, taking an over-all view of the matter in hand, a further a sum of Rs.30,000/- is ordered to be withdrawn by the petitioner from the amount, which is lying deposited in Oriental Bank of Commerce, Branch, Sector 8, Panchkula.
This Civil Revision stands disposed of in the above terms.
