Petitioner Sanjeev Kumar, apprehending his arrest in a non- bailable offence in case FIR No. 259 dated 15.5.2006 under Sections 419,420,467,468,471 and 506 IPC, registered at Police Station City Thanesar, District Kurukshetra, has filed this petition under Section 438 Cr.P.C. for anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioner contends that the petitioner admits execution of the agreement dated 11.2.2006 with the complainant for the sale of the plot and he also admits that he received an amount of Rs.1,60,000/- as earnest money. Counsel contends that the petitioner was always ready and is still ready to execute the sale deed of the aforesaid plot in favour of the complainant on the terms and conditions of the agreement.
He further contends that the earlier agreement entered into by the petitioner with Anoop Kumar and Ashok Kumar has already been cancelled and there is no embargo on the land.
Counsel for the petitioner further contends that in view of the order dated 21.12.2006, the petitioner has joined the investigation. This fact has not been disputed by the State Counsel.
In view of the above, the interim bail, granted vide order dated 10.11.2006 is made absolute subject to the same terms and conditions.
Disposed of accordingly.
