The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 51 dated 10.4.2006 under Sections 302,34,120-B IPC, registered at Police Station Lambra, District Jalandhar.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the respondent-State submitted that in this case three pieces of material evidence have been collected against the petitioner. First telephone conversation by the petitioner with the deceased; second extra judicial confession made before one Manjeet Singh and third recovery of gold chain of the deceased from the petitioner.
Counsel further states that now the case before the trial Court is fixed for 7.2.2007 for framing of the charge and immediately thereafter, the prosecution will examine Manjeet Singh, the alleged witness before whom extra judicial confession was made, which is one of the material evidence.
In view of the above, this petition is dismissed at this stage with liberty to the petitioner to approach again after recording of the statement of Manjeet Singh.
