The plaintiff is in regular second appeal. He has concurrently lost before the two Courts below.
He had filed a suit for declaration to the effect that he is owner in possession of 1/4th
share and that the defendant Nos. 1 and 2 are owners to the extent of 1/4th
share whereas defendant Nos. 3 to 7 are also owners of 1/4th
The claim was made by the plaintiff on the basis of an alleged Will dated August 1, 1992 claimed to have been executed by Gangu widow of Uttam Singh.
The aforesaid Will has never been produced by the plaintiff before the trial Court in spite of a large number of opportunities.
Consequently, the suit of the defendant had been dismissed by the trial Court.
The appeal filed by the plaintiff had also failed before the appellate Court.
Nothing has been shown that the findings recorded by the two Courts below suffer from any infirmity or are contrary to the record.
No question of law, much less any substantial question of law, arise in the present appeal.
