DATE OF DECISION:06.02.2007
Kulwinder Singh ..........Petitioner
State of Punjab ..........Respondent
CORAM:- HON'BLE MR. JUSTICE SATISH KUMAR MITTAL
Present:- Shri RS Rai, Advocate
for the petitioner.
Shri N.S. Gill, AAG, Punjab.
The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 231 dated 4.11.2006 under Sections 406 and 420/120-B, registered at Police Station Tanda, District Hoshiapur.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioner contends that as per the FIR an amount of Rs.4,50,000/- was given to co-accused Kuldeep Singh, who has been granted anticipatory bail. Counsel further contends that the petitioner is in custody since 5.11.2006 and the offence is to be tried by the Magistrate. Till date no prosecution witness has been examined.
Counsel for the respondent-State has not disputed this factual position.
Keeping in view the aforesaid facts, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of trial Court.
