Petitioner Rachhpal Singh, apprehending his arrest in a non- bailable offence in FIR No. 240 dated 20.12.2005 registered at Police Station Sultanwind under Sections 379/411 IPC, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.
I have heard counsel for the petitioner and gone through the contents of the FIR as well as the order dated 25.9.2006, passed by Additional Sessions Judge, Amritsar, whereby bail application of the petitioner has been dismissed.
In this case, a truck registered in Maharashtra, which according to the police was a stolen truck, was recovered by the police. When nakabandi was held, the same truck was being driven by Ravi Sher Singh and the petitioner was also sitting there. On seeing the police party, the petitioner ran away and Ravi Sher Singh was arrested at the spot. It is not the case of the petitioner that the truck belongs to him or to his brother. In these circumstances, I am not inclined to grant anticipatory bail to the petitioner, as his custodial interrogation is necessary.
