Petitioners Simpy and another filed the present petition under Section 482 Cr.P.C., for quashing of FIR No.64 dated 14.5.2006 registered at PS Division No.7, District Jalandhar under Sections 363,366,380 IPC.
Reply has been filed on behalf of the respondent State. The same has been taken on record.
I have heard learned counsel for the parties and have gone through the record.
In the reply filed by the State, it has been stated that after investigation the police has prepared cancellation report in the aforesaid case and the same has been sent to competent authority for approval and the same shall be submitted to the Illaqa Magistrate after approval.
In view of the stand taken by the respondent State, learned counsel for the petitioners does not press the petition and states that the same may be dismissed as withdrawn.
However, it will be open to the petitioners to approach again this court in case the cancellation report is not approved by the concerned authority or accepted by the Court.
