The petitioners, apprehending their arrest in a non-bailable offence in case FIR No.197 dated 10.10.2006 under Sections 379/120-B IPC, registered at PS City Kotkapura, have filed this petition under Section 438 Cr.P.C. for the grant of anticipatory bail.
Counsel for the petitioners contends that the complainant as well as petitioners no.1 and 2 are the Directors of M/s Unique Rice Pvt. Limited. He contends that actually, it is a dispute between the Directors and the allegation against the petitioners is that they in connivance with each other have stolen the paddy and rice from the factory premises. Counsel contends that at the most, it is a case of rendition of accounts and the petitioners have been falsely implicated in this case.
Learned counsel for the petitioners states that in terms of order dated 7.11.2006, the petitioners have joined the investigation.
Learned State counsel, on instructions from ASI Iqbal Singh does not dispute this fact.
In view of the above, without commenting on the merits, the interim bail granted vide order dated 7.11.2006, is made absolute subject to the same terms and conditions.
