Vide award dated July 28, 1987, Labour Court, Faridabad, ordered re-instatement in service of respondent No. 2. No order was passed regarding payment of back wages. Petitioner- Management came to this Court and on January 11, 1988, interim stay was granted till further orders and the same was confirmed on April 26, 1988. Despite that, vide order dated April 8, 1988, respondent No. 2 was taken back in service without prejudice to the decision of this writ petition. At the bar, it has been informed by counsel for the parties that thereafter respondent No. 2 worked with the petitioner and received his pay. Counsel for the petitioner further states that because of subsequent embezzlement committed by respondent No. 2, he was dismissed from service on August 10, 2001 and appeal against that order also stands dismissed. If that is so, this writ petition has virtually become infructuous and the same is disposed of accordingly.
