This is an appeal against the order dated December 29,2006 passed by learned Addl. District Judge, Karnal, whereby the appellant/defendant was restrained from running business under and name and style of "M/s Zee Drugs". In fact, the learned trial Court, is already seized of the matter and the appellant has every right to appear there and file an application for vacation of any such stay granted against him.
After hearing the learned counsel for the parties, this appeal is disposed of with a direction that both the parties shall appear before the learned trial Court on January 24,2007 and the learned trial Court shall dispose of the matter after hearing the learned counsel for the parties in accordance with law. It is further directed that the learned trial Court shall make every endeavour to dispose of the stay application within a week.
It is also to add here that learned counsel for the parties have agreed that in the meantime, counsel for the appellant/defendant, shall supply a copy of the application for vacation of stay as well as written statement to the learned counsel for the caveator/plaintiff.
A copy of this order be given dasti to learned counsel for the parties under signatures of this Court's Secretary.
