This is Regular Second Appeal against judgment dated 14.10.2005 passed by Additional District Judge, Panipat whereby an appeal filed by the defendants, now respondents was allowed to the extent that plaintiff was not entitled to the interest on the retiral benefits.
Plaintiff, now appellant happen to be son of the deceased employee of the defendant-State. Retiral benefits are stated to have already been paid. Trial Court had decreed the suit and observed that 6 % interest on the delayed payment of retiral benefits shall be payable whereas Additional District Judge held that unless the legal heirs of the deceased employee had claimed the amount, interest on the delayed payment could RSA.No.2912 of 2006 #2#
not be made and therefore interest was not payable.
No law point is involved in this appeal. Dismissed.
