The petitioner has sought transfer of the suit filed by her in respect of the property at Sangrur and pending in the Court of Civil Judge (Sr.Divn.), Sangrur, to the Court of competent jurisdiction at Yamuna Nagar. The transfer is sought on the ground that the husband of the plaintiff-petitioner is physically disabled to the extent of 80% and, therefore, it is not possible for the plaintiff-petitioner to prosecute the suit at Sangrur.
Though the husband of the petitioner is physically disabled, but the fact remains that the petitioner is not expected to attend the proceedings at Sangrur on each and every date of hearing. Since the property in dispute is situated at Sangrur, therefore, the Court at Sangrur is the most appropriate Court to entertain the present suit.
Therefore, I do not find any ground to transfer the suit titled as Sobha Rani versus Bimla Devi and others, from the Court of Civil Judge (Sr.Divn.), Sangrur.
Consequently, the present application stands dismissed.
