The petitioners have filed this petition under Section 482 Cr.P.C. for setting aside the orders dated 16.12.2005 and 21.12.2005, passed by Chief Judicial Magistrate, Rewari, whereby for the non- appearance of the petitioners, their bail bonds were cancelled and forfeited to the State and their non-bailable warrants were issued.
I have heard counsel for the parties.
Counsel for the petitioners contends that on 21.12.2005, petitioners No.1 and 3 to 6 were granted anticipatory bail under Section 307 IPC. In the morning, they did not appear before the trial Court, because by that time, anticipatory bail was not granted to them by Additional Sessions Judge.
Counsel for the respondent-State submits that in terms of the interim order dated 25.7.2006, the petitioners have appeared before the trial Court and furnished their regular bail bonds.
In view of the above, the interim bail, granted vide order dated 25.7.2006 is made absolute.
Disposed of accordingly.
