The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 139 dated 28.11.2001 under Sections 457/380/511 IPC, registered at Police Station Chabhal, District Amritsar.
I have heard counsel for the parties and gone through the contents of the FIR.
In the aforesaid case, it is alleged that the petitioner made an attempt to rob the Bank. In the said case, he was arrested in the year 2002 and subsequently released on bail, thereafter, he continuously appeared before the trial Court. During the pendency of challan, he absented himself and was declared as a Proclaimed offender. Now, he was arrested on 11.8.2006 and is in custody since then. After his arrest, supplementary challan has been submitted but no prosecution witness has been examined so far. Trial is not going to conclude soon.
Keeping in view the nature of allegations against the petitioner, custody period and the fact that the trial is not going to conclude soon, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of trial Court with an undertaking that in future he will regularly appear before the trial Court.
