Satyabir Singh v. Sunita Rani & Anr - CRM-80142-M-2006 [2007] RD-P&H 396 (15 January 2007)

IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

Crl.Misc.No. 80142-M of 2006

DATE OF DECISION: DECEMBER 21, 2006

Satyabir Singh

...PETITIONER

Sunita Rani and another

...RESPONDENTS

CORAM: HON'BLE MR.JUSTICE SATISH KUMAR MITTAL
Present: Mr.S.S.Walia , Advocate,

for the petitioner.

...

The petitioner, who is the husband, has filed this petition under Section 482 Cr.P.C. for setting aside the order dated 31.3.2005 passed by the JMIC, Sirsa and the order dated 8.11.2006 passed by the Sessions Judge, Sirsa, whereby the earlier order was confirmed in revision.

I have heard the counsel for the petitioner and gone through both the impugned orders.

Vide order dated 31.3.2005 passed by JMIC, Sirsa, the respondent-wife and her minor daughter Jinni were awarded maintenance of Rs.800/- and Rs.700/- per month, respectively, under Section 125 Cr.P.C.

On revision filed by the petitioner, the revisional court upheld the maintenance amount awarded to the minor daughter Jinni, but reduced the amount of maintenance awarded to the respondent wife from Rs.800/- to Rs.600/- per month. Aggrieved against the said order, the petitioner has filed the instant petition.

Counsel for the petitioner raised an argument that the amount awarded by the Courts below is excessive, keeping in view the income of the petitioner. I do not find any substance in this contention of the counsel for the petitioner. As per the salary certificate, the petitioner is earning Rs.3250/- per month and keeping in view the said fact, the amount awarded to the respondents is not excessive and unreasonable.

Dismissed.
