Learned counsel for the petitioner has invited our attention to the advertisement dated 1.10.2006 and the corrigendum dated 13.11.2006 to contend, that as against the 849 advertised posts of Physical Training Instructors, 60 were reserved to be filled up from amongst Ex- servicemen. It is submitted that the petitioner was fully eligible to be considered against the reserved seats meant for Ex-servicemen, and that, he applied well before the last date of submission of application forms and also submitted all the required certificates for verification. Despite the above, the respondents have chosen to fill up only 33 posts from Ex- servicemen, leaving vacant 27 of the 60 posts meant for Ex-servicemen.

Having considered the totality of the facts and circumstances of this case, including the fact, that the cadre of Physical Training Instructors is divided into male and female categories with equal number CWP NO. 19999 of 2006 2

of posts, and also, the fact that the advertisement, as well as, the corrigendum clearly depict that equal number of posts were ear-marked for female and male categories of candidates in the ratio of 50:50, we are satisfied that the claim of the petitioner cannot be accepted, inasmuch as, out of the 60 posts reserved for Physical Training Instructors, the pleadings reveal, that 30 posts have been filled up from male candidates.

Since the petitioner is also a male candidates, the claim of the petitioner does not merit acceptance.

The instant writ petition is, accordingly, dismissed.
