Mr. Tiwari has tendered a sum of Rs.12,000/- as arrears of maintenance.

Referring to order dated 04.04.2006 passed by learned Additional Sessions Judge( Adhoc ), Patiala, Mr. Tiwari submits that an amount of Rs.4000/- has been awarded without considering any evidence and without any justification for the same.

I have gone through the order dated 04.04.2006.

I agree with the contention of learned counsel. At this learned counsel for the respondent states that rather than remanding the case back for fresh decision the court may grant the amount of maintenance which may be agreed to between the parties.

Civil Revision No. 2647 of 2006

Both the learned counsel agree that a sum of Rs.2000/- may be fixed as maintenance. Mr. Tiwari states that though the husband in the present case is not doing any substantial employment and is leading the life at the mercy of his father yet he has a social obligation to discharge the liability of his wife and child. Therefore a sum of Rs.2000/- may be fixed as maintenance.

In view of the aforesaid, this revision petition is disposed of by directing that the petitioner shall pay an amount of Rs.2000/- per month to the respondent as maintenance with effect from 01.12.2006 onwards. The litigation expenses already stand paid.
