The petitioners have filed this petition under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 218 dated 30.11.2006 under Section 420 IPC, registered at Police Station Ghuman, Police District Batala, Tehsil Batala, District Gurdaspur, and the consequential proceedings.
I have heard counsel for the petitioners and gone through the contents of the FIR.
In the FIR, it has been alleged that the petitioners had taken specific amount from the complainant for sending him abroad. In view of the specific allegations levelled against the petitioners, I am not inclined to quash the FIR on the ground that part of the allegations are regarding payment of money in Malaysia. These are disputed questions of facts, which are subject matter of evidence.
