Learned counsel for respondent Nos. 2 and 3 has placed on record a copy of the letter dated 17.1.2007 in the connected C.W.P. No. 3263 of 2006 (Mark-A) and has pointed out that the respondent Corporation has decided to withdraw the proceedings under Section 32G of the State Financial Corporations Act, 1951 and C.W.P. No. 3993 of 2006
shall file civil suit for recovery of outstanding dues. We accept the statement made by the learned counsel and relegate the respondent Corporation to the remedy of filing suit if the same is maintainable in accordance with law.
In view of the above, the writ petition has been rendered infructuous and accordingly the same is disposed of.
