This is petition against order dated 9.1.2007 passed by Civil Judge(Jr.Divn.), Patiala whereby request of the petitioner for amendment in the written statement was declined.

Counsel for the defendant, now petitioner points out that the suit was barred by time and this amendment prayed was legal in nature and if allowed, no evidence shall be necessary.

In the circumstances, this petition is allowed. Petitioner shall be entitled to file amended written statement subject to payment of Rs.2000/- as costs to the plaintiffs, now respondents.
