Taranjeet Kaur & anr. v. State of Punjab & Ors. - CRM-81171-M-2006 RD-P&H 621 (18 January 2007)
Crl.Misc. No.81171-M of 2006
Date of Decision:- 23.1.2007
Taranjeet Kaur & anr. ....Petitioner(s)
State of Punjab & ors. ....Respondent(s) through
Mr.Amit Khanna, AAG, Punjab.
Mr.Mahesh Gupta, Advocate for
respondents No.4,5, & 6.
CORAM:-HON'BLE MR.JUSTICE SURYA KANT.
SURYA KANT, J.
The petitioners, who are stated to have born on 5.8.1986 and 12.12.1982 respectively and are, thus, major, seek a direction for protection to their life and liberty on the ground that they have got married on 15.12.2006 against the wishes of their parents and on that account, are being harassed by the local police on a complaint made by respondent No.4, who is father of petitioner No.1.
From the averments made in this petition and the scant material on record, there appears to be no factual basis and the allegations made by the petitioners against respondent Nos.4 to 6 are apparently unfounded.
Consequently, no direction for taking any kind of action against respondents No.4 to 6 is required to be issued at this stage.
However, having regard to the stand taken by the petitioners that they have got married and are now living as husband and wife, this petition is disposed of with liberty to the petitioners that in case of any actual and genuine threat to their life and liberty at the hands of respondents No.4 to 6 and/or anybody else, they may move an application/complaint to the SHO, Police Station, Raikot, District Ludhiana. If any such application is moved by them, the said SHO is directed to ensure forthwith that no harm is caused to the life and liberty of the petitioners.
