Learned counsel for the petitioner states that since the department has passed an order which goes against the interest of the petitioner, therefore, he would file a separate case against the department and as such, this contempt petition may be disposed as having become infructuous.

In view of the matter, main Contempt Petition bearing No. 889 of 2005, is dismissed as having become infructuous and petitioner would be at liberty to seek remedy available to him under the law.
