Petitioner Surjit Singh, who is complainant in FIR No. 117 dated 9.11.2006 registered at Police station Dyalpura, District Bathinda, under Section 306 IPC, has filed this petition under Section 482 of the Code of Criminal Procedure for transfer of the investigation of the case to some senior police officer of the rank of Superintendent of Police.
I have heard counsel for the petitioner.
Counsel for the petitioner contends that Shri Harjit Singh Pannu, is posted as Superintendent of Police (D), Bathinda and in the year 1995, a writ petition was filed by the petitioner against various police officers, including Mr. Pannu, therefore, the petitioner is apprehending that the local police will not investigate the matter fairly.
After hearing counsel for the petitioner, I am of the opinion that apprehension of the petitioner is totally mis-placed, because respondent No.3 is not the Investigating Officer. It is expected that the investigating agency will fairly investigate the matter.
Dismissed with the direction to the investigating agency to expedite the investigation in the aforesaid FIR.
