Petitioner Harjinder Singh apprehending his arrest in a non- bailable offence in case FIR No.182 dated 28.6.2004 under Sections 364,365,34 IPC, registered at PS Sector 11, Chandigarh has filed this petition under Section 438 Cr.P.C. for the grant of anticipatory bail.

I have heard learned counsel for the respondent State.

As per averments made in the petition, in the aforesaid case the petitoner was on regular bail and was regularly appearing, but on 11.10.2006, he could not appear before the trial court, as he suddenly fell ill.

It is case of the petitioner that he had intimated his friend to place on record the medical certificate and seek exemption, but application for exemption from personal appearance could not be filed. Therefore, bail bonds of the petitioner were cancelled and he has been summoned through non-bailable warrants. It is further averred that the absence of the petitioner on 11.10.2006 was not intentional, and now he is ready to appear before the trial court and furnish his fresh bail bonds.

Counsel for the respondent State further states that in terms of order dated 27.11.2006, the petitioner has appeared before the trial court and furnished his regular bail bonds and since then he is regularly appearing.

In view of the above, the interim order dated 27.11.2006, is made absolute subject to the same terms and conditions.

Disposed of accordingly.
