This is petition against judgment dated 7.12.2006 passed by Additional District Judge, Jagadhri whereby an appeal filed by the plaintiff, now petitioner against order dated 26.10.2006 passed by Civil Judge (Jr.Divn.), Jagadhri was dismissed.
It appears that the plaintiff had filed a suit for declaration for mandatory injunction. Dispute appears to be regarding the election of office bearers of Saraswati Sugar Mill Mazdoor Union, Yamuna Nagar. In that suit, an application U/o 39 Rule 1 & 2 CPC was filed for restraining respondent No.1 from acting as President and misutilizing the funds. That application was dismissed and then on appeal having been filed, C.R.No.515 of 2007 #2#
that had also been dismissed.
After going through the concurrent judgments of two courts below, I do not find any good ground to interfere at this stage.
Counsel for the petitioner points out that the tenure of the President is only three years and if there is delay in disposal of the suit, the purpose of the suit itself will be frustrated.
Under these circumstances, this petition is disposed of with direction to the trial Court to hold expeditious trial of the case and dispose of the case as expeditiously as possible.
