Petitioner Kuljeet Kaur, apprehending her arrest in a non-bailable offence in case FIR No.152 dated 25.10.2006 under Section 420 IPC registered at PS Dhariwal, District Gurdaspur has filed this petition under Section 438 Cr.P.C.
for the grant of anticipatory bail.
I have heard learned counsel for the parties and have gone through the contents of the FIR.
Petitioner no.2 is wife of petitioner no.1. Learned counsel for the petitioner contends that petitioner no.1, whose anticipatory bail application was dismissed by this Court has been granted interim anticipatory bail by the Hon'ble Apex Court. Counsel for the petitioner further states that in terms of order dated 2.11.2006, the petitioner has joined investigation, who has been falsely implicated.
The state counsel on instructions from HC Jagdish Singh, does not dispute this fact.
In view of the above, without commenting on the merits, the interim bail granted vide order dated 2.11.2006, is made absolute subject to the same terms and conditions.
Disposed of accordingly.
