Petitioners, six in number, apprehending their arrest in a non- bailable offence in case FIR No.113 dated 30.9.2006 under Sections 148/149/323/452/506 IPC, registered at PS Hassanpur, District Faridabad have filed this petition under Section 438 Cr.P.C. for the grant of anticipatory bail.
Vide order dated 2.11.2006 notice of motion was issued qua petitioners 1 and 3 only i.e. Sahabu and Ayub whereas petition qua petitioners 2 and 4 to 6 was dismissed as withdrawn.
I have heard counsel for the parties and have gone through the contents of the FIR.
Counsel for the petitioners states that in terms of the interim order dated 2.11.2006, petitioners Sahabu and Ayub have joined investigation and thereafter even challan has also been presented in the Court and they are no more required for investigation. Counsel for the respondent State does not dispute these facts.
In view of the above, without commenting on the merits, the interim bail granted to petitioners Sahabu and Ayub, vide order dated 2.11.2006 is made absolute subject to the same terms and conditions.
Disposed of accordingly.
