The prayer in this petition is to issue directions to the respondents to consider the petitioner's case for granting remissions and thereafter to release him prematurely.
The petitioner was sentenced to undergo 12 years' rigorous imprisonment for committing an offence under Section 363/366/376(2)(g) IPC, P.S.Chandni Bagh, Panipat. It is averred that he has completed the requisite length of sentence as required for premature release under the Government policy.
In the written statement, the respondents have come up with the plea that as against the requirement of 12 years' of actual sentence, the petitioner has so far completed 11 years 5 months and 26 days. It is stated that as and when he completes 12 years, his request will be immediately considered.
After hearing learned counsel for the parties and having regard to the stand taken by the respondents, this petition is disposed of with a direction to the respondents to take up the petitioner's case for release within one month before completion of the total actual period of sentence and to pass appropriate orders so that immediately on completion of the required period, the petitioner can be released.
