Petitioner Harbans Singh has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 109 dated 8.6.2005 under Sections 420/465/467/468/471 IPC, registered at Police Station Dharamkot, District Moga.

I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 21.6.2006, passed by Additional Sessions Judge, Moga, whereby bail to the petitioner has been declined.

In this case, it has been alleged that one Ranjit Singh son of Massa Singh took a loan of Rs. 5,00,000/- from State Bank of Patiala, Dharamkot, by furnishing the forged jamabandi for the year 1999-2000. It has been further alleged that the said forged jamabandi was issued by the petitioner, who is Halqa Patwari.

Counsel for the respondent-State could not point out that what evidence has been collected during the investigation, which indicates that jamabandi for the year 1999-2000 was issued by the petitioner.

The petitioner is in custody since 3.11.2005. Undisputedly, till date, no prosecution witness has been examined so far. The case is to be tried by the Magistrate and its conclusion is likely to take some time.

Keeping in view the aforesaid facts, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is, accordingly, ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
