This is regular second appeal against judgment dated 23.8.2006 passed by Additional District Judge-II, Jind whereby appeal filed by the appellant-State against judgment dated 30.9.2003 passed by Civil Judge (Sr.Divn.), Jind was dismissed.
Plaintiff Balwant Singh was an employee of the appellant-State.
Vide impugned judgment, interest at the rate of 12 % per annum had been granted by the Court of Civil Judge(Sr.Divn.), Jind on the delayed payment of retiral benefits. State filed appeal, which was dismissed.
On behalf of the State, it is argued that it was for the employee i.e plaintiff to have submitted complete pension papers six RSA.No.29 of 2007 #2#
months before his retirement but he submitted the papers late and therefore payment could not be made in time, still the courts below granted interest from the date of retirement.
I have gone through the judgments. There is concurrent finding. No law point is involved. Even if plaintiff had submitted the papers late, still State of Haryana had used the amount during the intervening period from the date of retirement till the date of payment.
No merit. Dismissed.
