Housing Board Haryana and another ......Respondents
CORAM HON'BLE MR. JUSTICE VINEY MITTAL
PRESENT Mr. Gorakh Nath,Advocate
VINEY MITTAL , J( Oral )
For the reasons stated in the applications, the delay in filing the present appeal is condoned.
The plaintiff has lost concurrently before two Courts below.
She is in second appeal. She filed a suit for declaration and for permanent injunction claiming that the notices for enhanced price issued by the Housing Board, Haryana for the allotted house in favour of the plaintiff were illegal and the plaintiff was not liable to pay the enhanced price.
Both the Courts below have held that as per the rules and regulations and the terms of allotment of the house in question, the plaintiff was bound by law to pay the enhanced price. It has also been noticed by the Courts below that the original price at which the house in question was allotted to the plaintiff was only a tentative price.
Nothing has been shown that the findings recorded by the two Courts below suffer from any infirmity or are contrary to the law.
No question of law, much less any substantial question of law, arising in the present appeal.
