O.P.No.3912 of 1999 Dated 9th October, 2006.

J U D G M E N T

The writ petition is filed mainly with the following prayers :-

(i) "Issue a writ of certiorari or other appropriate writ or order calling for the records leading to Exts.P8 and P12 proceedings of the first respondent and quashing the same; (ii) Issue a writ of mandamus or other appropriate writ or order directing the respondents to revert the 2nd respondent to his substantive post of Junior Recordist and, to promote the petitioner to the post of Sound Engineer with effect from the date on which his junior, the 2nd respondent was promoted as Sound Engineer; (iii) Issue a writ of mandamus or other appropriate writ or order directing the 1st respondent to provide notional promotion to the petitioner w.e.f. 1.4.1996 and to regularise such promotion forthwith, providing all consequential benefits including arrears of pay, admissible to the post of Sound Engineer;" The first respondent as well as the contesting respondent have filed counter affidavits. It is seen from the counter affidavits that the second respondent was duly qualified for promotion and that at the relevant time, the petitioner was not available, being on leave without allowance. It is also stated in the counter affidavit that as per the existing Government Orders, the petitioner cannot be given promotion as requested. In view of the stand thus taken in the counter affidavit, in case the petitioner has still any OP NO. 3912/1999 2 grievance, he may approach the Government. The writ petition is disposed of as above.
