O R D E RThe petitioners are accused of the offence, punishable under Sections 498A and 420 IPC, in crime No. 273/2006 of Thamarassery Police Station. The crime was registered at the instance of the wife of the first petitioner.
2. In the facts and circumstances of this case, I direct the petitioners to appear before the Judicial Magistrate of First Class-I, Thamarassery, on 12.7.2006 at 11.00 a.m. The petitioners may move application(s) for bail, after serving copy of the same to the APP, and the learned Magistrate shall dispose of the application(s), on the same day itself, on merit.
3. If the investigating officer desires to have the custody of the petitioners for interrogation, he also may move an application for the said purpose, before the learned Magistrate, which shall be heard and B.A.4050/2006 2 disposed of on merit. If the custody is not required, or not granted, the petitioners shall be released on bail, imposing such conditions, as are deemed necessary. The application is disposed of as above. J.M.JAMES
