J U D G M E N T
This writ petition is filed with the following prayers:-
i) To call for the records relating to Exts.P1 to P6 and to issue a writ of mandamus commanding the first respondent - Municipality - not to demand any amount by way of River Managing Committee from the petitioner consequent to Exts.P1 andP2 and also to declare that the auction purchaser - Petitioner - is not liable to pay any amount to River Managing Committee. ii) To issue a writ of mandamus commanding the first respondent to order refund of the amount collected from the petitioner by way of River Managing Committee fund which is evidenced by Exts.P5 to the petitioner. The petitioner has filed Ext.P6 representation before the 1st respondent. In case no orders have been passed on the said representation, there will be a direction to the 1st respondent/competent authority to look into the representation with notice to the petitioner and pass appropriate orders thereon in accordance with law, expeditiously. It will be open to the petitioner to take all available contentions before the concerned authority. The writ petition is disposed of as above.
