O R D E RWhen the application came up for consideration, the learned Public Prosecutor submitted that the petitioner is accused in five other criminal cases of similar nature. In this case, crime No.177/2006 of Nallalam Police Station, the petitioner had tried to snatch away the gold chain, worn by the defacto complainant, while the defacto complainant was walking, and the petitioner was on his motorbike. Therefore, he was arrested on 7.9.2006. Hence this application.
2. In the above facts situation, I agree with the arguments advanced by the learned Public Prosecutor that the release of the petitioner would not be contusive for the smooth progress of the investigation and for the safety of the persons of the locality. Therefore, the prayer of the petitioner, the first accused, is rejected. The application is dismissed as above. J.M.JAMES
