J U D G M E N T

The writ petition is filed with the following prayers:-

b) direct the respondents to pay the arrears of D.A and other benefits payable to the petitioners within a period of three months.

c) declare that non payment of eligible D.A. and other benefits, allowances,increments etc. payable to the petitioners are arbitrary, illegal and opposed to Article 14 and 16 of the Constitution of India. In similar circumstances, in writ petition 29529/2003, this

court passed the following judgment dated 20.10.2003:



"Petitioners are retired employees of the first respondent Company. This writ petition has been filed for enforcing payment of monetary benefits in respect of their employment. The parties pointed out that almost in identical circumstances a set of employees had filed an Original Petition, O.P.3687 of 2001. Taking notice of the financial difficulties of the respondent Company the court had directed that in a phased manner the benefits were payable to the petitioner. I direct that the same treatment that had been suggested in favour of such petitioners may also be extended to the petitioners herein also. Writ petition is disposed of as above". Being similarly situated, this writ petition is also disposed of making it clear that the petitioner herein also will be entitled to the judgment as extracted above.
