The petitioner seeks to quash Ext.P1 proclamation of sale issued by the Sub Court, Hosdurg.
2. The petitioner availed of a loan from the first respondent - Bank. She filed Ext.P2 application for getting the benefit of One Time Settlement Scheme. When the Writ Petition came up for admission, this Court directed the petitioner to pay an amount of Rs.25,000/- per month commencing from January, 2006. Learned counsel for the petitioner submits that the petitioner had already remitted Rs.47,000/-. In the above circumstances, it is only proper for the first respondent to consider the request of the petitioner for one time settlement. The first respondent is, therefore, directed to consider Ext.P2 application filed by the petitioner and pass appropriate orders thereon, if the petitioner is found eligible W.P.(C)NO.35526/2005 2 for the benefit. This shall be done within one month from the date of receipt of a copy of this judgment. Further steps, if any, against the petitioner shall be taken only after final decision is taken on Ext.P2 application. The Writ Petition is disposed of as above.
