Whether the rent fixed under Section 106 of the Kerala Land Reforms Act can be recovered under the provisions of the Kerala Revenue Recovery Act is the question to be considered in this case. The question is no more res integra, covered in favour of the petitioner by the Bench decision of this court in Joseph v. Gulam Gasool, 2002 (1) KLT 328. Therefore, the impugned recovery is quashed. Without prejudice to the liberty to the 4th respondent to take appropriate action to realise the rent the writ petition is allowed.
