O R D E RPetitioners who are accused Nos.2 and 3 in Crime No.84/04 of Cherplassery Police Station for offences punishable under sections 143, 147, 148, 341, 324, 326 and 506(ii) read with section 149 IPC, seek bail.
2. Consequent on the non-appearance of the petitioners in C.C.No.314/04 before the J.F.C.M., Ottappalam, non-bailable warrants of arrest are pending against the petitioners. Anticipatory bail cannot be granted in a case of this nature so as to nullify the process issued by a court of competent jurisdiction. There is no reason why the petitioners should not surrender before the trial court. Accordingly, if the petitioners surrender before the trial court and file an application for regular bail within 10 days from today, the same shall be considered and disposed of, preferably on the same date on which it is filed, after considering the explanation offered by the petitioners for their previous non-appearance. With this observation, this bail application is dismissed.
