J U D G M E N T

The writ petition is filed with the following prayer:-

i) call for the records leading to the case and issue a writ of certiorari or any other appropriate writ, order or direction, quashing Ext.P2 to the extent it acquires the residential building owned by the petitioner. Inviting reference to Government letter dated 22.6.2004, it is stated that the residential building is not to be affected as per the said Government Order. A copy of the Government letter will be marked as 'X'. This court has also recorded the submission made by the counsel for the petitioner that the Deputy Collector had informed the petitioner that only sunshade need be demolished. Accordingly this writ petition is disposed of directing the respondents 2 to 4 to take action in the matter only in the light of the Government letter referred to above. In case any clarification is required, it is further made clear that it will be open to the parties to approach the Government. Petitioner submits that the sunshade can be demolished by the petitioner. In view of the above submission, it is made clear that if the required demolition is only on the sunshade the petitioner shall be permitted to do the same.
