ORDERIn this petition filed under Sec. 439 Cr.P.C., the petitioner who is the 9th accused in Crime No. 575/06 of Chengamanadu Police Station for offences punishable under Secs. 395, 412 and 120 B of I.P.C, seeks bail.
2. The learned Director General of Prosecutions opposed the application.
3. The occurrence took place in broad day light at 3 p.m. on 9- 10-2006. When the de facto complainant was proceeding to Nedumbassery Airport in a Palio Car, his car was intercepted by another Car in which the accused were travelling. This happened on the Airport road at Athani. After dragging out the 4 inmates including the de facto complainant, the assailants robbed them off 14.484 kgms. of gold meant for export. This was a pre-planned operation. Accused Nos. 13,15 and 16 are yet to be apprehended and major part of the gold is yet to be seized by the police. If at this stage of investigation, the petitioner is released on bail, he will definitely intimidate the prosecution witnesses, get in touch with the absconding B.A. No. 6962 of 2006 -:2:- accused and hamper with the smooth investigation of the case which includes recovery of the balance quantity of the gold. I am not inclined to grant bail to the petitioner. This bail application is accordingly, dismissed. V. RAMKUMAR,
