The petitioner is the third accused, in crime No.138/2006 of Thenmala Police Station. He is before this Court, under Section 438 Cr.P.C. The records reveal that the accused 7 and 10 were granted relief under Section 438 Cr.P.C., in B.A.No.3704/2006. Accused 1 and 5 in this crime, were also granted relief, under the same section, in B.A.No.3403/2006.2. In such circumstances, I direct the petitioner to appear before the Judicial Magistrate of First Class, Punalur, on 20.7.2006 at 11.00 a.m. If an application for bail is moved by the petitioner, with a prior notice to the APP of that Court, the learned Magistrate shall dispose of the same, after hearing both sides, and release the petitioner on bail, on the same day itself.
