JUDGMENT

Heard counsel for the petitioner and Standing Counsel appearing for respondent.

2. Even though petitioner's complaint is that final determination is an ex-parte order, after hearing the respondent's counsel I find that the petitioner was not co-operating and therefore he is not entitled to get one more opportunity. Standing Counsel pointed out that petitioner has not even remitted the amount recovered from employees.

3. In the circumstances and having regard to the petitioner's age and financial position expressed by counsel for the petitioner, petitioner is granted time upto 31st of this month to pay the amount recovered from employees and the balance amount on or before 31st January, 2007. Coercive steps for recovery should be kept in abeyance till 31st January and in the event of default in payment by 31-1-2007, the respondent will proceed for recovery of entire amount and consider prosecution for misappropriation of recovered amounts. Petitioner will pay applicable rate of interest for belated payment. Writ petition is disposed of as above.
