O R D E RThe petitioners 1 to 4 are accused of the offence, punishable under Section 55(a) of the Abkari Act, as the Kadakkal Police Station registered crime No.307/2006, for the reason that they were found in illegal possession of twelve liters of Indian Made Foreign Liquor, on 23.6.2006. The petitioners 1 and 2 were arrested on 23.6.2006 and petitioners 3 and 4 were arrested on 24.6.2006. They remain in judicial custody from the date of remand by the Judicial Magistrate of First Class-II, Kottarakkara.
2. I heard both sides. The learned counsel submitted that the petitioners had came to the vending shop for purchasing Indian Made Foreign Liquor and they were going together, as the residence of the petitioners are about thirty kilometers away from the shop, from where they had purchased the Indian Made Foreign Liquor. 3. In the facts and circumstances of this case, I
grant bail and release the petitioners from jail, subject to
the following conditions:-
(a). Each petitioner shall execute a bond for Rs.25,000/-, with two solvent sureties, each for the like sum, to the satisfaction of the Judicial Magistrate of First Class-II, Kottarakkara.
(b). Each petitioner shall report before the Investigating Officer, once in a week on every Friday, between 10.00
a.m and 11.00 a.m., for a period of two months, starting from 21.7.2006. The application is allowed as above. J.M.JAMES
