The father-in-law of the respondent is the petitioner herein. Respondent filed O.S.579/06 on the file of Family Court, Kottayam for realisation of money and gold ornaments. This petition is filed to transfer that case to Family Court, Kottarakara. The case of the petitioner was that his son, the husband of the respondent, is working in Gulf countries and petitioner is 68 years old and his wife is blind and in such circumstance, it is not possible for him to travel to Kottayam and contest the case and case is to be transferred to Kottarakara.

2. Learned counsel appearing for petitioner and respondent were heard.

3. The wife is residing at Velloor within the jurisdiction of Family Court, Kottayam. For the convenience of the father-in-law of the respondent Tr.P(C)266/06 2 it is not proper to transfer the case to Kottarakara and cause inconvenience to the wife. Petition for transfer is therefore dismissed. Learned counsel appearing for petitioner then submits that presence of the petitioner may not be insisted by the Family Court. It is made clear that unless absolutely necessary, Family Court shall not insist for the presence of the petitioner on posting dates. M.Sasidharan Nambiar Judge tpl/-
