Ramachandran, J:Interim order passed in I.A.No.1290 of 2005 in O.S.No.5 of 2005, on the file of the Additional District Court, Kottayam is subjected to challenge in this appeal. By virtue of the interim orders passed by this Court, it is possible for the defendant to continue to use the trade name 'Hand Guard', which according to the respondent herein causes irreparable injury to him.
2. However, it will be more appropriate, it seems that the suit itself is disposed of within a deadline prescribed. Counsel on both sides submit that full co-operation will be shown to ensure that the matter is finally disposed of within a reasonable time.
3. We set the date of final disposal of O.S.No.5 of 2005 as 31st of March, 2007. In any case, the interim orders passed by this Court staying the operation of the order of the court below dated 25-02-2006 will be in operation only up to 31st of March, 2007. We make it clear that we have not expressed any [FAO No.89 of 2006] -2- opinion about the merits of the contentions raised by the parties. The appeal is disposed of with the above direction.
