J U D G M E N T
The writ petition is filed with the following prayers:- iii) issue a writ of certiorari or appropriate writ or direction or order quashing condition No.13 in Ext.P2 regarding the condition of payment of 50% of D.C.R.G. and Commuted Value of Pension.
v) declare that the petitioner is entitled to penal interest at the rate of 12% on the above amounts from 1.07.2000 to the date of its payment. It is seen that there is an interim order in C.M.P.24641/2001 to pay 50% of the D.C.R.G. Petitioner has filed Ext.P4 representation before the 1st respondent. There is no counter affidavit. There will be a direction to the 1st respondent to look into Ext.P4 with notice to the petitioner and take appropriate action thereon in accordance with law, if not already taken, within a period of three months from the date of production of a copy of this judgment. It is made clear that the claim of the petitioner for interest will also be adverted to by the 1st respondent while taking action as above. The writ petition is disposed of as above.
