O R D E RPetitioners who are accused Nos.2 and 3 in Crime No.690/2005 of Kottarakkara Police Station for offences punishable under Secs.498-A and 306 read with sec.34 I.P.C., seek anticipatory bail.
2. Prasanna Kumari, the wife of the 1st accused, allegedly committed suicide at 11 p.m. on 22.7.2005. Their marriage was on 11.9.1994. Petitioners herein are the sisters of the 1st accused.
3. The case is now pending before the J.F.C.M.-I, Kottarakkara as C.P.179/2006. Petitioners had previously sought anticipatory bail from this court as per B.A.No.4840/2005. This court was not inclined to grant them anticipatory bail but, instead, directed them to surrender before the magistrate who was directed to dispose of their bail application expeditiously. Admittedly, the petitioners have not approached the magistrate with an application for regular bail. Instead, they have again sought for anticipatory bail. There is no reason why the petitioners should not seek regular bail Bail A.No.7227/2006 -:2:- after surrendering before the committed court. Accordingly, if the petitioners surrender before the magistrate and file an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which it is filed.
