The petitioners are before this Court, under Section 438 Cr.P.C. When the application came up for consideration, the learned Public Prosecutor submitted that no crime is registered against the petitioners, in Museum Police Station of Thiruvananthapuram. However, it is also submitted that there is a complaint against them, preferred by one Rajendran Pillai, and further submission is that the amount due to the petitioners had been repaid by the said Rajendran Pillai. However, the R.C.Book and other details of the vehicle, belonging to Rajendran Pillai, are being retained by the petitioners. Hence, he preferred the complaint. For the purpose of enquiry on the complaint, the petitioners are required before the police.2. In such situation, I dispose of this petition directing the Investigating Officer to issue notice to the petitioners, as and when the petitioners are required to B.A.4049/2006 2 appear in the police station, for the completion of the enquiry on the complaint, preferred by Rajendran Pillai.
